According to The New York Times, the plaintiffs are not asking the courts to overturn the Texas ban on the proceedings.
However, they are seeking assurance that doctors can do this in cases where it is not safe to continue the pregnancy, or if the fetus is unlikely to survive outside the womb.
The vice president’s statement also highlighted an encounter with Amanda Zurawski, one of the plaintiffs.

At least 13 states have barriers to abortion, after overturning last June the ruling known as Roe v. Wade, which ruled in 1973 that the Constitution protected a woman’s freedom to terminate her pregnancy, without excessive government restrictions.
For the Center for Reproductive Rights, these barriers create chaos for patients, the doctors, and the hospitals that treat them, by making it a crime to provide this standard and crucial procedure for treating the many serious medical conditions that arise during pregnancy.
Texas law allows doctors to perform this procedure only to save the life of a pregnant patient. According to a New York Times investigation, although, in theory, some rules in restricted areas allow exceptions in certain circumstances, very few have been granted since the Supreme Court’s decision.
